《2017 年聯合國 ( 反恐怖主義措施 ) ( 修訂 ) 條例草案》旨在修訂《聯合國 ( 反恐怖主義措施 ) 條例》,禁止以恐怖主義行為或恐怖主義培訓為目的而進行旅程,禁止提供或籌集財產以資助 以恐怖主義行為或恐怖主義培訓為目的的旅程,及禁止組織 或協助以恐怖主義行為或恐怖主義培訓為目的的旅程,以進 一步實施聯合國安全理事會一四 年 九 月二十四日第 二一七八 號決議 中的決定;禁止處理關乎恐怖分子或與恐怖分子有聯繫者的 財產,以進一步實施財務行動特別組織的建議;就違反有關 禁制訂立罪行;令若干紀律部隊的人員能夠為執行有關禁制 而行使他們現有的法定權力;以及作出相關修訂。

 

 

基本法第三十一條
香港居民有在香港特別行政區境內遷徙的自由,有移居其他國家和地區的自由。香港居民有旅行和出入境的自由。有效旅行證件的持有人,除非受到法律制止,可自由離開香港特別行政區,無需特別批准。

 

第一百零五條
香港特別行政區依法保護私人和法人財產的取得、使用、處置和繼承的權利,以及依法徵用私人和法人財產時被徵用財產的所有人得到補償的權利。

 

 

United Nations (Anti-Terrorism Measures) (Amendment) Bill 2017:

 

The Hong Kong SAR Govet. proposes to amend the United Nations (Anti-Terrorism Measures) Ordinance to prohibit travelling, providing or collecting property to finance travel, and organizing or facilitating travel, for the purpose of terrorist acts or terrorist training;  and to prohibit dealing with property relating to terrorists or terrorist associates. The closing date for submission of views is 5 pm today. The Bill may be in contravention of Articles 31 and 105 of the Basic Law and Articles 13 and 17 of the Universal Declaration of Human Rights, and, if enacted, may be used by the Hong Kong SAR Government to prevent dissidents from leaving the territory or from possessing their own property. In other ways, the HKSAR Govt. may label dissidents or pro-independence Hong Kong citizens as terrorists and deprive them of the right to travel and the right to the use of their own assets. The prohibition of travelling in the name of anti-terrorism is in contravention of Article 31 of the Basic Law: “Hong Kong residents shall have freedom to travel and to enter or leave the Region.” The right to freedom of movement is also enshrined in Article 13 of the Universal Declaration of Human Rights.

 

Moreover, the prohibition of dealing with property relating to terrorism may violate Article 105 of the Basic Law: “The Hong Kong Special Administrative Region shall, in accordance with law, protect the right of individuals and legal persons to the acquisition, use, disposal and inheritance of property and their right to compensation for lawful deprivation of their property.” The right to private property is also protected by Article 17 of  the Universal Declaration of Human Rights .

Invitation for submissions

The Bills Committee on United Nations (Anti-Terrorism Measures) (Amendment) Bill 2017 invites interested parties to give views on the Bill. The Bill seeks to amend the United Nations (Anti-Terrorism Measures) Ordinance (Cap. 575) and other legislation to (a) further implement a decision of the Security Council of the United Nations in its Resolution 2178 of 24 September 2014 by prohibiting travelling, providing or collecting property to finance travel, and organizing or facilitating travel, for the purpose of terrorist acts or terrorist training; (b) further implement the Recommendations of the Financial Action Task Force by prohibiting dealing with property relating to terrorists or terrorist associates; (c) create offences for contravening the prohibitions; (d) enable officers from certain disciplinary forces to exercise their existing statutory powers to enforce the prohibitions; and (e) make related amendments. The duration of the meeting may be adjusted subject to the number of deputations attending the meeting.
